Terms of Service
Last updated: 2 October 2026
These Terms of Service (the “Terms”) govern your access to and use of the website, mobile application, emails, and other online products and services provided by IT TRAVEL LP, a limited partnership incorporated in Scotland, Company Number SL024264, with its registered office at Suite 4054 Mitchell House, 5 Mitchell Street, Edinburgh, Scotland, EH6 7BD (“Octripus,” “we,” “us,” or “our”).
Together, these products and services are referred to as the “Services.”
These Terms apply to users who create or use Guides, purchase subscriptions or other paid features, sell Guides through the Services, purchase Paid Guides, or otherwise access or use the Services.
The Terms are presented when you create an Account and remain available through the Services. If you purchase a Paid Guide without creating an Account, these Terms also apply to that purchase and your access to the Paid Guide.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.
Nothing in these Terms affects any mandatory rights available to consumers under applicable law.
1. Definitions
For the purposes of these Terms:
“Account” means an account created to access or use the Services.
“Creator” means a user who creates, publishes, shares, or sells a Guide using the Services.
“Buyer” means a person who purchases access to a Paid Guide.
“Guide” means digital travel content created, assembled, published, or made available through the Services, including itineraries, place collections, descriptions, recommendations, tips, images, maps, and related content.
“Paid Guide” means a Guide that a Creator offers for purchase through the Services.
“Guide Purchase” means a transaction through which a Buyer purchases access to a Paid Guide.
“Your Content” means any text, images, photographs, video, audio, voice recordings, recommendations, descriptions, tips, data, or other material that you submit, upload, create, or provide through the Services.
“Subscription” means a recurring paid plan offered by Octripus.
“Platform Fee” means the fee retained by Octripus from the sale of a Paid Guide. Unless otherwise expressly stated before the transaction, the Platform Fee is 10% of the Guide Purchase price, excluding any taxes and payment processing fees where applicable.
“Payment Processor” means Stripe or any other third-party payment provider used in connection with payments or payouts through the Services.
2. Access to the Services
By using the Services, you represent and warrant that:
(A) You are at least 16 years old and have reached the minimum age required under the laws of your country of residence to use the Services;
(B) You have the legal capacity to enter into a binding agreement with Octripus or, if you are under the age of majority in your jurisdiction, your parent or legal guardian has reviewed and agreed to these Terms;
(C) You are not prohibited from using the Services under applicable law; and
(D) You have not been permanently suspended or removed from the Services.
If you accept these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.
Certain features, including selling Paid Guides or receiving payouts, may be subject to additional eligibility, identification, verification, tax, or payment requirements.
3. Privacy and Data Protection
The collection and processing of personal data in connection with the Services is governed by our Privacy Policy.
IT TRAVEL LP acts as an independent data controller in respect of personal data processed in connection with the Services in accordance with applicable data protection legislation, including the UK GDPR and, where applicable, the GDPR.
By using the Services, you acknowledge that you have read and understood the Privacy Policy.
Where processing is based on consent, such consent will be obtained separately where required by applicable law.
Payments, seller verification, payouts, fraud prevention, and related financial services may require certain information to be provided to and processed by Payment Processors such as Stripe in accordance with their own terms and privacy policies.
Nothing in these Terms creates a joint controllership, employment, agency, partnership, franchise, or joint venture relationship between you and Octripus.
4. Your Account
You are responsible for maintaining the confidentiality and security of your Account credentials and for activities carried out through your Account.
You agree to provide accurate, complete, and current information and to update such information where necessary.
You must notify us promptly if you become aware of unauthorized access to your Account or any other security breach.
You may not sell, assign, or transfer your Account without our prior written consent.
If you use the Services as a Creator offering Paid Guides, you may be required to provide additional identity, business, contact, tax, or payment information to Octripus or our Payment Processor.
You are responsible for ensuring that such information is accurate and current.
5. License to Use the Services
Subject to your compliance with these Terms, Octripus grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to:
(A) install and use the Octripus mobile application on devices owned or controlled by you; and
(B) access and use the Services for lawful purposes.
Creators may use the Services commercially for the purpose of creating, publishing, sharing, and selling their own Guides where such functionality is expressly provided by Octripus.
This permission does not give you the right to sell, license, sublicense, copy, distribute, reproduce, commercially exploit, or create a competing service from the Octripus platform, software, technology, design, databases, or other proprietary materials.
All rights not expressly granted under these Terms are reserved.
We may modify, update, suspend, or discontinue all or part of the Services. Where required by applicable law, we will provide appropriate notice of material changes affecting paid Services.
6. Your Content and Intellectual Property
You retain ownership of Your Content.
By uploading, submitting, creating, publishing, or otherwise making Your Content available through the Services, you grant Octripus a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, format, modify as technically necessary, display, transmit, and otherwise use Your Content for the purposes of operating, providing, securing, maintaining, and improving the Services.
Where you publish or sell a Guide, this license also includes the rights reasonably necessary for Octripus to display, distribute, deliver, and provide access to that Guide to intended recipients and Buyers.
Except as described below for Guides that have already been purchased, this license ends when Your Content is permanently deleted from the Services, except where continued retention is required for backups, security, fraud prevention, legal compliance, dispute resolution, or other legitimate purposes.
You represent and warrant that:
(A) you own Your Content or have all rights, permissions, licenses, and consents necessary to use it through the Services;
(B) Your Content does not infringe intellectual property, privacy, publicity, contractual, or other rights of any third party;
(C) you have the right to commercially use any photographs, video, audio, text, or other material included in a Paid Guide; and
(D) your use of Your Content through the Services complies with applicable law.
All rights in the Octripus platform, software, interfaces, designs, trademarks, logos, branding, databases, and other proprietary materials remain the exclusive property of Octripus or its licensors.
7. Publishing Guides
Creators may publish Guides through the functionality made available by Octripus.
Once a Guide has been published, the published version may be locked from further editing. If a Creator wishes to make material changes, a new or duplicated version may need to be created and published separately.
The Creator remains responsible for the accuracy, legality, quality, and appropriateness of the final published Guide.
Publication by Octripus does not constitute approval, verification, certification, or endorsement of a Guide or its contents.
Octripus may remove, restrict, suspend, or disable access to a Guide where we reasonably believe that it:
(A) violates these Terms;
(B) infringes third-party rights;
(C) contains unlawful content;
(D) involves fraud, abuse, or payment manipulation;
(E) creates a material security or legal risk; or
(F) must be restricted to comply with applicable law or a lawful authority request.
8. AI-Generated Content
The Services may use artificial intelligence technologies to generate, structure, edit, translate, summarize, or otherwise assist with content.
AI-generated content may contain inaccuracies, omissions, outdated information, or recommendations that are unsuitable for a particular person, location, or situation.
Users and Creators are solely responsible for reviewing and verifying generated content before relying on it, publishing it, sharing it, or selling it.
Creators remain responsible for the final content of their Guides even where some or all of that content was generated or assisted by Octripus AI tools.
Octripus does not guarantee the accuracy, completeness, reliability, availability, legality, or suitability of AI-generated content.
The fact that a Guide was created using Octripus does not mean that Octripus has reviewed, verified, approved, or endorsed that Guide.
9. Prohibited Conduct
You may not use the Services to:
interfere with, disrupt, damage, or impair the Services;
attempt to gain unauthorized access to systems, data, Accounts, or networks;
upload or distribute viruses, malicious code, or harmful software;
infringe intellectual property, privacy, publicity, or other third-party rights;
scrape, crawl, extract, or collect data by automated means without authorization;
use the Services to develop or train a substantially competing product or service without authorization;
engage in fraudulent, deceptive, misleading, abusive, or unlawful conduct;
manipulate purchases, payments, refunds, reviews, payouts, or chargebacks;
make fraudulent purchases or use payment methods without authorization;
sell content that you do not have the legal right to sell;
misrepresent the contents, features, price, origin, or nature of a Paid Guide;
use the Services in violation of sanctions, financial crime, consumer protection, tax, or other applicable laws.
We may investigate suspected violations and may suspend Accounts, Guides, selling functionality, purchases, or payouts while an investigation is ongoing.
10. Octripus Subscriptions and Paid Features
Certain features of the Services require a Subscription or other payment to Octripus.
By purchasing a Subscription, you agree to pay the price, applicable taxes, and other charges disclosed to you before purchase.
Subscriptions renew automatically at the end of each billing period unless cancelled before renewal.
You may cancel your Subscription through the available Account settings. Cancellation takes effect at the end of the current paid billing period unless otherwise required by applicable law.
We may change Subscription prices or features. Where required by applicable law, we will provide advance notice before a price change applies to an existing Subscription.
Unless otherwise stated, price changes for recurring Subscriptions will apply no earlier than thirty (30) days after notice.
Certain Octripus features may also be offered as one-time purchases. One-time purchases do not automatically renew.
Payments for Octripus Subscriptions and paid features may be processed through third-party Payment Processors.
11. Selling Paid Guides
Creators may offer eligible Guides for sale through functionality provided by Octripus.
For each Paid Guide, the Creator is the seller of the Guide.
Octripus provides technology that enables Creators to create, publish, offer, deliver, and receive payment for Paid Guides. Except where applicable law provides otherwise, Octripus is not the seller of the Creator's Paid Guide.
When a Buyer purchases a Paid Guide, the contract for the supply of that Paid Guide is between the Creator and the Buyer.
The Creator is responsible for:
(A) the Paid Guide and its contents;
(B) ensuring that the Guide matches its description;
(C) setting the Guide price using the available functionality;
(D) having all rights necessary to sell the Guide;
(E) complying with applicable consumer, intellectual property, tax, advertising, and other laws;
(F) providing accurate seller and verification information where required; and
(G) fulfilling any applicable obligations arising from the sale.
Creators must accurately indicate any information requested by Octripus concerning their identity or status as a professional trader, business, or private individual.
Where required by applicable law, Octripus may display relevant seller information to Buyers.
Octripus may restrict selling functionality until required verification has been completed.
12. Seller Verification and Stripe
Payments and payouts for Paid Guides are processed through Stripe or another Payment Processor selected by Octripus.
To sell Paid Guides and receive payouts, a Creator may be required to create or connect a payment account and complete onboarding, identity verification, business verification, or other checks required by the Payment Processor.
The Creator agrees to provide accurate and complete information requested as part of this process.
The Creator's use of Stripe services is also subject to applicable Stripe agreements and policies.
Octripus does not control Stripe's independent verification decisions and does not guarantee that a Creator will be approved to receive payments or payouts.
Selling or payout functionality may be restricted, delayed, or suspended until verification requirements have been satisfied.
13. Platform Fee, Processing Fees and Payouts
For each successful Paid Guide sale, Octripus charges a 10% Platform Fee.
Payment processing fees charged by Stripe or another Payment Processor may apply separately.
Unless otherwise expressly stated before the relevant transaction, the Creator's proceeds are calculated from the Guide Purchase amount after deduction of:
(A) the 10% Octripus Platform Fee;
(B) applicable Payment Processor fees;
(C) refunds, reversals, disputes, or chargebacks where applicable;
(D) taxes or amounts required to be withheld by law, where applicable; and
(E) other amounts properly due in connection with the transaction.
Payment Processor fees may vary depending on payment method, country, currency, currency conversion, card type, transaction type, or other factors determined by the Payment Processor.
Octripus does not guarantee any particular payout date. Payout timing may depend on Stripe or another Payment Processor, verification status, bank processing times, fraud or risk reviews, disputes, reserves, and applicable law.
Creators authorize Octripus and the applicable Payment Processor to deduct amounts due under these Terms from amounts otherwise payable to them where permitted by law.
14. Purchasing Paid Guides
A Buyer purchasing a Paid Guide purchases access to the published digital Guide, not ownership of the Creator's intellectual property.
Unless otherwise stated, a Guide Purchase is a one-time purchase.
Upon successful payment, the Buyer receives a limited, personal, non-exclusive license to access and use the Paid Guide for personal purposes.
You may share your permanent purchase code or access link for personal use. Anyone with either can open the purchased material.
The Buyer may not, without permission from the applicable rights holder:
resell the Paid Guide;
sublicense access to it;
reproduce or redistribute substantial parts of it;
make it publicly available;
commercially exploit it; or
provide access to third parties for commercial purposes.
The Creator retains ownership of the intellectual property in the Paid Guide, subject to any third-party rights that may apply.
Before purchasing a Paid Guide, Buyers should review the description, price, Creator information, and other information displayed on the purchase page.
15. Access to Purchased Guides
A Paid Guide is supplied as a specific published version.
Published Guides cannot be edited after publication through the standard editing functionality. A materially different or updated Guide may be published separately.
If a published Guide has never been sold, the Creator may delete it where the Services permit this.
If a Paid Guide has been purchased by at least one Buyer, the Creator may not permanently delete that Guide in a way that removes access for existing Buyers.
Octripus may retain the relevant published version of a purchased Guide for the purpose of continuing to provide access to existing Buyers, even if the Creator later closes or deletes their Account.
This retention does not give Octripus ownership of the Creator's intellectual property.
Access may nevertheless be restricted or removed where required by law, a court or regulatory order, intellectual property rights, security requirements, or where continuing to provide the content would itself be unlawful.
Where a purchased Guide must be removed for such reasons, applicable statutory rights and remedies remain unaffected.
16. Travel Information and Third-Party Services
Guides may contain information about restaurants, attractions, transport, accommodation, events, activities, businesses, prices, opening hours, routes, safety conditions, entry requirements, or other third-party services.
Such information may change after a Guide is published.
Neither Octripus nor, unless expressly stated, the Creator controls third-party businesses or services mentioned in a Guide.
Users should independently verify important information before travelling, booking, purchasing, or relying on recommendations, particularly information relating to safety, visas, entry requirements, health, transportation, opening hours, availability, and prices.
A reference or link to a third-party product, business, website, service, or location does not constitute an endorsement by Octripus.
Octripus is not a party to transactions entered into directly between a user and third-party travel providers merely because such providers are mentioned in a Guide.
17. Refunds and Consumer Cancellation Rights
17.1 Octripus Subscriptions and Paid Features
Refund and cancellation rights for Subscriptions or other services purchased directly from Octripus are subject to applicable law and the conditions presented at the time of purchase.
If you are a consumer and applicable law gives you a statutory cancellation or withdrawal right, nothing in these Terms limits that right.
Where digital services begin immediately at your request, applicable consumer law may affect your cancellation rights.
To request assistance regarding a payment made directly to Octripus, contact [email protected].
17.2 Paid Guides
Paid Guides constitute digital content supplied electronically.
Where applicable law provides a statutory cancellation or withdrawal period for digital content, the Buyer retains that right unless it has been validly lost or waived in accordance with applicable law.
Where a Buyer requests immediate access to a Paid Guide during an applicable statutory cancellation period, the Buyer may be asked to:
(A) expressly consent to the immediate supply of the digital content; and
(B) acknowledge that the applicable cancellation or withdrawal right may be lost once supply begins,
where required by applicable law.
Providing access to a Paid Guide does not exclude any statutory rights or remedies relating to digital content that is defective, unlawful, materially different from its description, unavailable, or otherwise non-conforming under applicable law.
Outside mandatory statutory rights, refunds for Paid Guides may be considered in circumstances including:
duplicate or erroneous charges;
failure to provide access following successful payment;
material technical failure;
a Paid Guide materially differing from its description;
fraud or unauthorized payment;
removal of content where a refund or other remedy is required; or
other circumstances determined by the Creator, Octripus, the Payment Processor, or applicable law.
Nothing in these Terms guarantees a discretionary refund after digital content has been successfully supplied and accessed.
18. Refunds, Disputes and Chargebacks
A Guide Purchase may be subject to refund, reversal, payment dispute, or chargeback.
Where a transaction is refunded, reversed, disputed, or charged back, amounts relating to that transaction may be deducted from the Creator's available or future proceeds where applicable and permitted by law.
Such amounts may include:
the refunded transaction amount;
payment processing costs;
chargeback or dispute fees;
currency conversion costs;
amounts previously paid to the Creator; and
other transaction-related costs imposed by the Payment Processor.
The allocation of particular Payment Processor costs may depend on the type of transaction, the applicable Stripe configuration, the reason for the refund or dispute, and applicable law.
Octripus may withhold, offset, or recover amounts from future payouts where necessary to settle amounts properly due in relation to refunds, disputes, chargebacks, fraud, or payment reversals.
If Octripus receives a complaint relating to a Paid Guide, we may facilitate communication between the Buyer and Creator or take other reasonable action. Doing so does not make Octripus the seller of the Guide.
19. Taxes
Creators are responsible for determining and complying with tax, registration, reporting, invoicing, and similar obligations applicable to income they earn through Paid Guides, except to the extent that Octripus or a Payment Processor is required by law to collect, report, withhold, or remit particular amounts.
Octripus may request tax or identification information where necessary to comply with legal, regulatory, reporting, or payment obligations.
Where required by law, Octripus or a Payment Processor may report transaction, seller, or payout information to tax or governmental authorities.
Buyers are responsible for taxes applicable to their purchases to the extent required by applicable law.
20. Suspension and Termination
You may request deletion or termination of your Account through the functionality made available in the Services.
Unless immediate deletion is required by applicable law, an Account may first be deactivated and may be restorable for up to thirty (30) days following the deletion request.
After the applicable restoration period, Account data and content may be permanently deleted or anonymized, except where continued retention is necessary for:
providing existing Buyers with access to previously purchased Paid Guides;
processing pending payments or payouts;
handling refunds, disputes, or chargebacks;
tax or accounting obligations;
fraud prevention and security;
enforcement of these Terms;
legal claims;
regulatory compliance; or
other obligations under applicable law.
A Creator's Account deletion does not automatically terminate a Buyer's access to a Paid Guide that was purchased before the Creator's Account was deleted.
We may suspend, restrict, or terminate access to all or part of the Services where reasonably necessary, including where:
(A) these Terms have been violated;
(B) fraud, payment abuse, or security risks are suspected;
(C) required verification has not been completed;
(D) continued access could expose Octripus, users, or third parties to legal or security risk; or
(E) suspension or termination is required by applicable law or a competent authority.
Where appropriate and legally required, we will provide notice and an opportunity to remedy the issue.
Termination does not affect rights, obligations, payments, refunds, disputes, or liabilities that arose before termination.
21. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Octripus and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, costs, and reasonable legal expenses arising from or relating to:
(A) your violation of these Terms;
(B) Your Content;
(C) your infringement of third-party rights;
(D) your unlawful or fraudulent use of the Services;
(E) where you are a Creator, your Guides or sale of Paid Guides;
(F) your failure to comply with applicable tax, consumer, intellectual property, advertising, or other legal obligations; or
(G) claims arising from information, promises, descriptions, or representations made by you to Buyers.
This section does not apply to the extent that liability results from Octripus' own unlawful acts or where indemnification cannot lawfully be required.
22. Disclaimers
The Services are provided on an “as is” and “as available” basis.
To the fullest extent permitted by applicable law, Octripus disclaims warranties not expressly set out in these Terms.
Octripus does not guarantee that:
the Services will always be available, uninterrupted, secure, or error-free;
all information generated or displayed by the Services will be accurate or current;
a Creator will make any particular amount of revenue;
a Guide will generate sales;
a particular Buyer, Creator, Guide, destination, venue, or third-party service will meet a user's expectations; or
third-party payment or other services will always remain available.
Nothing in this section excludes warranties or rights that cannot lawfully be excluded.
23. Limitation of Liability
To the fullest extent permitted by applicable law, Octripus shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, business opportunities, goodwill, or data.
Except where Octripus is itself legally responsible, Octripus is not liable for:
the contents of Creator Guides;
transactions or disputes between Creators and Buyers;
acts or omissions of third-party travel providers;
decisions made in reliance on travel recommendations;
changes to third-party prices, opening hours, availability, transport, or services;
interruptions or decisions by Stripe or other Payment Processors; or
losses caused by information supplied by another user.
To the maximum extent permitted by applicable law, Octripus' total aggregate liability arising out of or relating to these Terms or the Services shall not exceed the greater of:
(i) the total amount paid by you directly to Octripus during the twelve (12) months preceding the event giving rise to the claim; or
(ii) EUR 100.
Nothing in these Terms excludes or limits liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
intentional misconduct where liability cannot be excluded;
mandatory consumer rights; or
any other liability that cannot lawfully be excluded or limited.
24. Force Majeure
Octripus shall not be responsible for failure or delay caused by circumstances beyond its reasonable control, including natural disasters, war, civil disturbance, government action, internet or telecommunications failures, widespread infrastructure failures, strikes, epidemics, or other comparable events.
This section does not affect rights that cannot be excluded under applicable law.
25. Governing Law and Jurisdiction
These Terms and disputes arising out of or in connection with them are governed by the laws of Scotland.
The courts of Scotland shall have jurisdiction over disputes arising from these Terms.
However, if you are a consumer, this choice of law and jurisdiction does not deprive you of any mandatory protections or rights available under the laws of your country of habitual residence, including any right to bring proceedings before courts that have jurisdiction under applicable consumer law.
26. Changes to these Terms
We may update these Terms from time to time to reflect changes to the Services, business model, payment functionality, applicable law, security requirements, or other operational requirements.
The current version and its effective date will be made available through the Services.
Where changes materially affect your rights or obligations, we will provide reasonable advance notice where required by applicable law.
We may require you to expressly accept material changes before continuing to use certain features, including selling or payment functionality.
Continued use of the Services after revised Terms become effective may constitute acceptance where permitted by applicable law.
Transactions already completed remain subject to applicable legal rights and obligations and are not retroactively deprived of mandatory protections.
27. Miscellaneous
These Terms, together with the Privacy Policy and any additional terms expressly applicable to a particular Service or feature, constitute the agreement between you and Octripus concerning your use of the Services.
Participation in the Octripus Partner Program is subject to separate Partner Program Terms.
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will continue in effect.
Our failure to enforce any provision does not constitute a waiver of that provision.
You may not assign your rights or obligations under these Terms without our prior written consent.
Octripus may assign or transfer its rights and obligations in connection with a merger, acquisition, corporate restructuring, sale of assets, or other lawful business transfer, subject to applicable law.
Headings are included for convenience and do not affect interpretation.
Provisions that by their nature should survive termination, including provisions concerning intellectual property, purchased Guide access, outstanding payments, refunds, chargebacks, taxes, indemnification, limitations of liability, and dispute resolution, will survive termination.
